# Terms of Service — Hill-Fi Status Page Notifications

## 1. Acceptance of Terms
These Terms of Service ("Terms") govern your use of the Hill-Fi Status Page and its email and SMS notification service ("the Service"), operated by Hill-Fi Internet Services LLC ("Hill-Fi," "we," "us," or "our"). By subscribing to notifications or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
## 2. Description of the Service
The Service is a status communication tool that:
- Displays the current operational status of Hill-Fi's network and services at https://status.hillfi.com.
- Allows you to subscribe, free of charge, to receive notifications by email and/or SMS about service outages, scheduled maintenance, and incident updates.
The Service is provided as a courtesy and is **not a guarantee of notification**. Notifications are best-effort and may be delayed or fail to deliver due to factors outside our control (carrier issues, your provider's spam filters, network problems, etc.).
## 3. Eligibility
You must be at least 18 years old to subscribe. By subscribing, you represent that:
- You are the authorized user of the email address and/or phone number you provide.
- You consent to receive automated notifications at the contact information you provide.
- The information you provide is accurate.
## 4. Subscription and Consent
### Email notifications
By providing your email address and confirming via the verification link, you consent to receive notifications about Hill-Fi service status. You can unsubscribe at any time by clicking the unsubscribe link in any email.
### SMS notifications
By providing your mobile phone number and confirming via verification code, you consent to receive automated text messages from Hill-Fi about service outages and scheduled maintenance.
- **Message frequency varies** based on network events. Most months you will receive few or no messages; during outages you may receive several.
- **Message and data rates may apply** depending on your carrier plan.
- Reply **STOP** to any message to unsubscribe. Reply **HELP** for help.
- We do not charge you to receive messages; carrier charges (if any) are between you and your wireless carrier.
- Carriers are not liable for delayed or undelivered messages.
- Supported carriers may change over time; we cannot guarantee delivery on any particular carrier.
## 5. Your Responsibilities
You agree to:
- Keep your contact information current.
- Use the Service only for its intended purpose.
- Not attempt to disrupt, attack, or reverse-engineer the Service.
- Not use the Service to harass, defraud, or impersonate any person.
## 6. Subscription Management and Termination
You may unsubscribe from email notifications at any time by clicking the unsubscribe link in any email or by managing preferences at https://status.hillfi.com.
You may unsubscribe from SMS notifications by replying **STOP** to any message.
We may terminate or suspend your access to the Service at any time, with or without notice, if you violate these Terms or for any other reason at our discretion. We may also discontinue the Service entirely.
## 7. No Warranty
The Service is provided "as is" and "as available." Hill-Fi makes no warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy, reliability, or uninterrupted availability of the Service.
You acknowledge that:
- The Service may be unavailable from time to time.
- Notifications may be delayed, missed, or incorrect.
- The status information displayed may not reflect real-time conditions.
- The Service is **not** a substitute for emergency services. Do not rely on the Service in any emergency.
## 8. Limitation of Liability
To the maximum extent permitted by law, Hill-Fi and its officers, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of the Service, whether based in contract, tort, or any other legal theory.
In no event shall our total liability to you for any claim arising from the Service exceed one hundred U.S. dollars ($100.00).
## 9. Indemnification
You agree to indemnify and hold harmless Hill-Fi from any claims, losses, or damages, including reasonable attorneys' fees, arising out of your use of the Service or your violation of these Terms.
## 10. Privacy
Your use of the Service is also governed by our [Privacy Policy](https://hillfi.com/privacy), which is incorporated into these Terms by reference.
## 11. Modifications to the Terms
We may update these Terms at any time. The updated Terms will be posted at this URL with a revised "Last Updated" date. For material changes, we will make reasonable efforts to notify subscribers by email. Continued use of the Service after a change constitutes acceptance of the updated Terms.
## 12. Governing Law and Disputes
These Terms are governed by the laws of the State of Indiana, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or the Service shall be brought exclusively in the state or federal courts located in Indiana, and you consent to the personal jurisdiction of those courts.
## 13. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
